Terms of Service

The rules for using the MHADA Rental Portal, for both tenants and landlords. Please read them carefully — your use of the portal means you accept them.

1. Acceptance of terms

By creating an account on the MHADA Rental Portal or by using any part of the portal, you agree to be bound by these Terms of Service ("Terms"), the Privacy Notice, and all applicable laws of India and the State of Maharashtra.

If you do not agree with any part of these Terms, do not use the portal.

2. Eligibility to use

You must be at least 18 years of age and legally competent to enter into a contract in India.

You must provide accurate, current and complete information during registration, and keep your information up to date.

Institutional landlords (societies, trusts, companies and public bodies) must register through their authorised signatory with valid authorisation.

3. Your account

Your account is personal. You must not share credentials, allow others to use your account, or create more than one account per Aadhaar.

You are responsible for all activity that happens under your account.

Notify us immediately at grievance@mhada.gov.in if you suspect unauthorised access.

4. Role of the portal

The portal is a facilitation platform between tenants and landlords. The rent agreement, once signed, is between the tenant and the landlord. MHADA is not a party to that agreement unless the property is owned by MHADA.

For MHADA-owned rental units, allotment decisions are made by the competent authority under MHADA regulations; the portal is the channel through which those decisions are communicated and enforced.

5. Tenant obligations

Complete Aadhaar eKYC and submit true and current documents.

Apply only for properties and categories for which you are eligible.

Pay rent, maintenance and any applicable deposits on time through the portal.

Use the premises only for the purpose stated in the agreement and comply with society rules.

Not sublet, transfer or mortgage the tenancy without written consent of the landlord and MHADA, where applicable.

6. Landlord obligations

List only properties you legally own or are authorised to rent.

Keep listings truthful — photographs, rent, amenities, carpet area and location must reflect the actual property.

Respond to applications within the timelines published on the dashboard.

Use MHADA-approved templates and lawful terms in rent agreements.

Return deposits as per the agreement and make repairs that are the landlord's responsibility under the Maharashtra Rent Control Act.

7. Payments, stamp duty and taxes

All rent, deposits and statutory fees for transactions created through the portal must be paid through the portal's payment gateway.

Stamp duty and registration fees are computed from the current Maharashtra Stamp Act and Registration Act and collected at the time of signing.

TDS (where applicable under the Income Tax Act) is deducted at source and a certificate is issued through the portal.

All payments are final unless reversed by the portal in case of a payment gateway error.

8. Prohibited conduct

Uploading false, forged, misleading or tampered documents.

Impersonating another person or entity, or misrepresenting your affiliation.

Requesting or making payment outside the portal in connection with a listing.

Harassing, threatening, or discriminating against another user on any basis including caste, religion, gender or disability.

Attempting to probe, scan, reverse-engineer, scrape, or disrupt the portal or its security.

Any activity that violates Indian law.

9. Listings and user content

You grant MHADA a non-exclusive, royalty-free, worldwide licence to store, display and reproduce content you upload (photographs, documents, messages) for the purpose of operating the portal and performing statutory obligations.

You represent that you own or have the right to upload the content, and that it does not infringe any third-party rights.

MHADA may remove content that violates these Terms or the law, and may suspend accounts that repeatedly post such content.

10. Suspension and termination

We may suspend or terminate an account for violation of these Terms, suspected fraud, non-payment, or a direction by a court or statutory authority.

You may close your account from the profile page. Closure does not erase data that we are legally required to retain (see the Privacy Notice).

Active agreements continue to bind the parties even after an account is closed.

11. Disclaimers

The portal is provided on an "as is" and "as available" basis.

MHADA does not warrant that the portal will be uninterrupted, error-free, or free of security issues at all times.

Listing on the portal is not an endorsement of the landlord, tenant or property by MHADA, except for properties explicitly marked as MHADA-allotted.

12. Limitation of liability

To the maximum extent permitted by law, MHADA's aggregate liability for any claim arising out of or in connection with the use of the portal is limited to the portal fees received from the claimant in the twelve months preceding the claim.

MHADA is not liable for indirect, incidental, consequential or punitive damages.

Nothing in these Terms limits liability that cannot be limited under Indian law.

13. Governing law and jurisdiction

These Terms are governed by the laws of India.

Courts at Mumbai have exclusive jurisdiction over any dispute arising out of these Terms, subject to mandatory venue rules under the Maharashtra Rent Control Act.

14. Changes to these Terms

We may update these Terms. Material changes will be notified through the portal and by email 30 days before they take effect.

Continued use of the portal after the effective date constitutes acceptance of the updated Terms.
